When scouring through legal definitions, one of the first terms described in the criminal code is an active arrest warrant. In Monroe County, TN, arrest warrants are judicial orders issued against an individual when he is suspected of being involved in a felony.

Unlike bench warrants issued against people who fail to show up in court or abscond after bail has been granted, an active arrest order is a court decree that is solely issued when the police make a formal request for it.

To do so, they approach the local criminal tribunal and file an affidavit that shows the magistrate why they suspect a particular individual and why it was assumed that the act in question was a crime, to begin with. Witnesses may also be called in to strengthen the argument in favor of the cops.

Regardless of the evidence presented, the judge has to be convinced of the probable cause before he/she signs an order making it a Monroe County active warrant. Once this is done, the detention decree never goes out of effect; it is merely stored in the system in various forms.

For instance, warrants that are freshly issued are held under the name active warrants, while those that cannot be executed are stored as outstanding warrants, and those that lead to detention are kept in the form of arrest records.
